Vertragspartner und Gegenstand Lizenzgeber ist Thomas Korzekwa, www.mix4cast.de („Lizenzgeber“). Dieser Vertrag regelt die Nutzung der Software mix4cast einschließlich aller mitgelieferten Bestandteile, Aktualisierungen und Unterlagen („Software“). Mit der Installation oder Nutzung der Software stimmen Sie diesem Vertrag zu. 2. Nutzungsrecht Sie erhalten ein einfaches, nicht übertragbares Recht, die Software auf Computern zu nutzen, die Sie besitzen oder kontrollieren. Alle nicht ausdrücklich eingeräumten Rechte bleiben beim Lizenzgeber und seinen Lizenzgebern. 3. Bestandteile von NDI® Die Software enthält das NDI® Software Development Kit („NDI SDK“) und Teile davon (insbesondere die Bibliothek libndi) der Vizrt NDI AB (vormals NDI, Inc., zusammen „NDI“). Für diese Bestandteile gilt zusätzlich: a) Es ist untersagt, das NDI SDK, die NDI-Produkte oder Teile davon zu verändern. b) Es ist untersagt, das NDI SDK, die NDI-Produkte oder Teile davon sowie die vom NDI SDK oder den NDI-Produkten verwendeten Protokolle – gleich ob über ein Netzwerk übertragen oder empfangen oder intern bzw. extern auf dem physischen oder virtuellen Rechner verwendet – zurückzuentwickeln (Reverse Engineering), zu disassemblieren oder neu zu kompilieren, sowie jeder Versuch dazu. c) Es ist untersagt, technische Beschränkungen des NDI SDK, der NDI-Produkte oder von Teilen davon zu umgehen. d) Es ist untersagt, Schutzrechtsvermerke oder Kennzeichnungen im oder am NDI SDK, an den NDI-Produkten oder an Teilen davon zu entfernen, unkenntlich zu machen oder zu verändern. e) NDI und jeder seiner Lizenzgeber übernehmen keinerlei Gewährleistung. f) Soweit gesetzlich zulässig, haften NDI und/oder seine Lizenzgeber nicht für Schäden jeglicher Art – unmittelbare, mittelbare, Neben- oder Folgeschäden –, die aus der Nutzung der Software entstehen. g) Sie verpflichten sich, alle einschlägigen Exportgesetze und -vorschriften der Vereinigten Staaten von Amerika einzuhalten und die Software oder Teile davon weder unmittelbar noch mittelbar entgegen US-Recht auszuführen. h) Urheberrechtsvermerk: NDI® SDK © 2023–2026 Vizrt NDI AB (NDI, Inc.). Alle Rechte vorbehalten. i) Wer die Software (zum Beispiel über ihre Programmierschnittstelle) nutzt, um eigene Produkte zu entwickeln, die NDI verwenden („Produkte Dritter“), muss die Bedingungen der NDI-SDK-Lizenz einhalten, einschließlich einer jederzeit aktuellen und vollständigen NDI-Kompatibilität dieser Produkte, und muss die Bedingungen dieses Abschnitts 3 in den eigenen Endbenutzer-Lizenzvertrag übernehmen. Software von Dritten Die Software enthält weitere Programme Dritter, die unter eigenen Lizenzen stehen: FFmpeg (GNU Lesser General Public License, Version 3), libsrt (Mozilla Public License 2.0) und Mbed TLS (Apache License 2.0). Für diese Bestandteile gelten ausschließlich deren Lizenzen; dieser Vertrag schränkt die daraus folgenden Rechte nicht ein. Lizenztexte, Versionen und Bezugsquellen der Quelltexte finden Sie in der App unter Contents/Resources/ThirdParty. 5. Sonstige Beschränkungen Außer soweit gesetzlich zwingend erlaubt oder in Abschnitt 4 vorgesehen, dürfen Sie die Software nicht verändern, zurückentwickeln, vermieten oder unterlizenzieren. 6. Gewährleistung und Haftung des Lizenzgebers Die Software ist für Live-Produktionen gedacht; prüfen Sie Ihre Sendungen vor dem Einsatz. Der Lizenzgeber haftet unbeschränkt bei Vorsatz und grober Fahrlässigkeit, bei Verletzung von Leben, Körper oder Gesundheit sowie nach dem Produkthaftungsgesetz. Bei leicht fahrlässiger Verletzung wesentlicher Vertragspflichten ist die Haftung auf den vorhersehbaren, typischen Schaden begrenzt; im Übrigen ist die Haftung für leichte Fahrlässigkeit ausgeschlossen. Gesetzliche Gewährleistungsrechte von Verbrauchern bleiben unberührt. 7. Schlussbestimmungen Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts; zwingende Verbraucherschutzvorschriften des Staates, in dem Sie Ihren gewöhnlichen Aufenthalt haben, bleiben unberührt. Sollte eine Bestimmung unwirksam sein, bleibt der Vertrag im Übrigen wirksam. ====================================================================== ENGLISH ====================================================================== 1. Parties and subject The licensor is Thomas Korzekwa, www.mix4cast.de ("Licensor"). This agreement governs the use of the software mix4cast including all components, updates and documentation supplied with it ("Software"). By installing or using the Software you agree to this agreement. 2. Licence You receive a non-exclusive, non-transferable right to use the Software on computers you own or control. All rights not expressly granted remain with the Licensor and its licensors. 3. NDI® components The Software contains the NDI® Software Development Kit ("NDI SDK") and parts of it (in particular the library libndi) of Vizrt NDI AB (formerly NDI, Inc., together "NDI"). For these components the following also applies: a) Any modification of the NDI SDK, the NDI Products or any part thereof is prohibited. b) Any reverse engineering, disassembly or recompilation of the NDI SDK, the NDI Products or any part thereof, or of any protocols used by the NDI SDK or the NDI Products, whether transmitted or received over a network or used internally or externally to the machine, physical or virtual, it is operating on, and any attempt to do so, is prohibited. c) Any circumvention of any technical limitations in the NDI SDK, the NDI Products or any part thereof is prohibited. d) Removing, obscuring or altering any proprietary notices or labels contained on or within the NDI SDK, the NDI Products or any part thereof is prohibited. e) NDI and each of its licensors disclaim any and all warranties. f) To the extent permitted by applicable law, NDI and/or its licensors disclaim liability for any damages, whether direct, indirect, incidental or consequential, arising from the use of the Software. g) You shall comply fully with all relevant export laws and regulations of the United States to assure that the Software or any part thereof is not exported, directly or indirectly, in violation of United States law. h) Copyright notice: NDI® SDK © 2023–2026 Vizrt NDI AB (NDI, Inc.). All rights reserved. i) Anyone using the Software (for example through its programming interface) to develop products of their own that use NDI ("Third Party Products") must comply with the terms of the NDI SDK licence, including that such Third Party Products have current and complete NDI compatibility, and must include the terms of this section 3 in their own end user licence agreement. These components are governed solely by their licences; this agreement does not restrict any rights granted by them. Other restrictions Except where mandatory law allows it or section 4 provides otherwise, you may not modify, reverse engineer, rent or sublicense the Software. 6. Warranty and liability of the Licensor The Software is meant for live productions; check your broadcasts before use. The Licensor is liable without limitation for intent and gross negligence, for injury to life, body or health and under product liability law. For slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract; otherwise liability for slight negligence is excluded. Statutory warranty rights of consumers remain unaffected. 7. Final provisions German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection law of the country of your habitual residence remains unaffected. Should a provision be invalid, the rest of this agreement remains valid.
